The Spanish Mortgage Act (Ley Hipotecaria) is a fundamental regulation that governs the rights and obligations of property owners and mortgage guarantees. In 2015, a major reform was carried out in Spain to modernise and simplify the process of registering property. Ley 13/2015, of 24 June, reforming the Ley Hipotecaria and the Ley del Catastro Inmobiliario, introduced significant changes to the process of registering property at the Land Registry (Registro de la Propiedad).
The land surveyor’s role in property registration
Land surveyors are key professionals in the property registration process. Their role is fundamental to putting the reform of the Ley Hipotecaria into practice. Measuring land, georeferencing and updating the cartography are necessary tasks that land surveyors carry out to apply the Ley Hipotecaria.
Georeferencing every property
The reform of the Ley Hipotecaria includes the obligation to georeference all real estate and the need to update the existing cartography. To do so, land surveyors carry out precise topographic surveys that define the geographic coordinates of each property. In this way, greater precision and reliability are guaranteed in the registration of property.
Technical reports and graphic validation
Land surveyors also prepare technical reports and graphic validations of parcels to check that properties are correctly delimited and to avoid possible cadastral errors. In this way, the process of registration at the Land Registry is made easier.
In summary, land surveyors are key professionals in putting the reform of the Ley Hipotecaria into practice. Thanks to their work, greater precision and reliability are guaranteed in the registration of property. The cartography is updated and cadastral errors are avoided. In short, it is a process that benefits all property owners and society as a whole.
